1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and GweensCraft (operating as Gweens AgriTech) governing your use of the Gweens AgriTech mobile application (package ID: com.gweth.gweensagritech), website at agritech.gweenscraft.co.ke, API services, IoT hardware and sensor kits, and all related services (collectively, the "Service").
By creating an account, downloading the app, or using any part of the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
2. Description of Service
Gweens AgriTech is a precision agriculture platform designed for smallholder farmers in Kenya. The Service includes:
- Farm management — digital tools to map, track, and manage farms and plots using GPS and geospatial data
- IoT sensor integration — real-time monitoring of soil moisture, temperature, humidity, pH, and nutrient levels via connected sensors
- Smart irrigation — automated and scheduled irrigation control based on sensor thresholds
- Pest and disease detection — AI-powered analysis of crop photos to identify diseases and recommend treatments
- Alert system — SMS and push notification alerts for critical farm conditions
- Agronomist consultations — access to professional agronomists for farm advisory services
- Marketplace — a platform for farmers to sell produce and buyers to purchase agricultural goods
- Reports and analytics — yield tracking, financial summaries, and sensor trend analysis
3. Eligibility
To use Gweens AgriTech, you must:
- Be at least 18 years of age, or between 13 and 17 years of age with the explicit consent and supervision of a parent or legal guardian
- Have the legal capacity to enter into a binding agreement under Kenyan law
- Provide accurate and truthful registration information
- Not be barred from receiving services under applicable law
The Service is designed for use in Kenya and is operated in compliance with Kenyan law. Users outside Kenya may access the Service but do so at their own risk and are responsible for compliance with their local laws.
4. User Accounts
Registration
To access most features, you must register for an account providing your full name, email address, phone number, and a chosen role (Farmer, Buyer, Agronomist, or Admin). You agree to provide accurate, current, and complete information and to keep it updated.
Account security
You are responsible for maintaining the confidentiality of your password. You agree to notify us immediately at agritechsupport@gweenscraft.co.ke if you suspect unauthorised access to your account. You are responsible for all activity that occurs under your account.
One account per user
Each individual may hold only one primary account. Creating multiple accounts to circumvent limits or bans is prohibited.
Account roles
Accounts are assigned one of four roles that determine access to features:
- Farmer — access to farm management, sensors, irrigation, disease detection, marketplace listings, and analytics
- Buyer — access to marketplace browsing, ordering, and order tracking
- Agronomist — access to consultation management and farm advisory tools
- Admin — internal use only; managed by GweensCraft
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable Kenyan law or regulation, including the Kenya Data Protection Act, 2019, Computer Misuse and Cybercrimes Act, 2018, and Consumer Protection Act, 2012
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Upload, post, or transmit any content that is fraudulent, misleading, defamatory, obscene, or harmful
- Attempt to gain unauthorised access to our systems, other user accounts, or any connected IoT devices
- Interfere with, disable, or circumvent any security feature of the Service
- Use automated tools (bots, scrapers, scripts) to access the Service without our express written permission
- Introduce malware, viruses, or any malicious code into the Service or connected devices
- Engage in any activity that could overload or impair the Service's infrastructure
6. Farmer and Buyer Obligations
Farmers
- Provide accurate information about your farm, including location, acreage, crops grown, and soil conditions
- Ensure that product listings on the marketplace are accurate in description, quantity, price, and quality
- Honour marketplace orders once confirmed, including delivering goods within the agreed timeframe and condition
- Take responsibility for the safe and correct installation of IoT sensor hardware (or engage our technicians — see Section 8)
- Not represent sensor data or AI-generated advice as a substitute for professional agronomic assessment in all circumstances
Buyers
- Provide accurate delivery information and respond promptly to farmer communications
- Make payment as required before or at the time of order confirmation
- Raise any quality or delivery disputes within 48 hours of receipt through the in-app dispute mechanism
- Not attempt to transact outside the platform to avoid marketplace fees
7. Agronomist Obligations
If you register as an Agronomist, you additionally agree to:
- Hold genuine, current, and valid professional qualifications relevant to agricultural advisory services in Kenya
- Provide honest, professional, and accurate advice based on the information available to you
- Disclose any conflict of interest (e.g., financial relationship with a product supplier) before making recommendations
- Respond to accepted consultations within the timeframe agreed with the farmer
- Not misrepresent your qualifications, experience, or the efficacy of any recommended treatment
- Comply with the guidelines of the Kenya Agricultural and Livestock Research Organisation (KALRO) and any other relevant professional bodies
GweensCraft reserves the right to remove Agronomist status from any user who fails to meet these standards, at its sole discretion.
8. IoT Hardware and Sensors
Hardware supply
Gweens AgriTech may supply IoT sensor kits (ESP32-based soil moisture, temperature, pH, and NPK sensors) for purchase or rental. Hardware is subject to separate commercial terms provided at the time of purchase.
Installation
You may install sensor hardware yourself following the documentation provided in the app, or engage a Gweens AgriTech technician. GweensCraft is not liable for damage to hardware or loss of data arising from incorrect self-installation.
Sensor accuracy
Sensor readings are provided as indicative data points to assist farm decision-making. Sensor accuracy may be affected by calibration drift, soil composition, extreme weather, or hardware defects. You acknowledge that sensor data should be used alongside — not as a replacement for — your own observation and professional advice.
Hardware liability
Hardware warranty terms are provided with the sensor kit documentation. GweensCraft is not liable for loss of produce, revenue, or other consequential losses arising from sensor malfunction or data inaccuracies.
Connectivity
Sensor operation requires internet or mobile data connectivity. You are responsible for ensuring adequate connectivity at your farm location. Data recorded offline is queued and synced when connectivity is restored.
9. Marketplace Rules
Permitted listings
Farmers may list fresh agricultural produce, seeds, fertilisers, pesticides (properly licensed), and agricultural tools for sale. All listings must include accurate descriptions, photographs, and pricing in Kenyan Shillings (KSh).
Prohibited items
The following may not be listed or sold on the marketplace:
- Counterfeit products or products misrepresented as certified (e.g., falsely labelled "organic" or "GlobalG.A.P. certified")
- Pesticides or agro-chemicals not registered with the Pest Control Products Board (PCPB) of Kenya
- Stolen or misappropriated goods
- Any item the sale of which is prohibited under Kenyan law
- Non-agricultural goods unrelated to farming
Transaction fees
GweensCraft may charge a commission on marketplace transactions. Current fee rates are displayed in the app before listing confirmation. Fees are subject to change with 30 days' notice.
Disputes
Buyers must raise disputes within 48 hours of receiving goods. GweensCraft acts as a facilitator and may, at its discretion, mediate disputes but is not liable for the outcome of transactions between farmers and buyers.
Ratings and reviews
Buyers may submit honest ratings and reviews after completing an order. Reviews must not contain false statements, personal attacks, or content unrelated to the transaction.
10. Intellectual Property
Gweens AgriTech IP
The Gweens AgriTech name, logo, app design, software code, algorithms (including the crop disease detection model), database structure, and all related content are the exclusive intellectual property of GweensCraft. Nothing in these Terms grants you any right to use GweensCraft's intellectual property without express written permission.
Your data
You retain ownership of your farm data — including sensor readings, farm maps, crop records, and transaction history. By using the Service, you grant GweensCraft a limited, non-exclusive, worldwide licence to store, process, and display your data solely for the purpose of providing the Service to you. This licence terminates when you delete your account.
GweensCraft may use anonymised, aggregated, and de-identified datasets (e.g., aggregated crop yield statistics across all users) for product improvement and research. Such aggregated data cannot be used to identify you.
11. User-Generated Content
"User-Generated Content" includes product listings, product photographs, marketplace reviews, consultation messages, support ticket content, and any other content you submit to the Service.
You represent and warrant that:
- You own or have the right to submit the content
- The content does not infringe any third party's intellectual property, privacy, or other rights
- The content is truthful and not misleading
GweensCraft reserves the right to remove any content that violates these Terms or that we determine to be harmful to other users or the platform, without prior notice.
12. Third-Party Services
The Service integrates with third-party services including Supabase, Google Firebase, Google Maps, OpenWeatherMap, and Africa's Talking. Your use of these services through our platform is also subject to their respective terms of service and privacy policies. GweensCraft is not responsible for the availability, accuracy, or conduct of third-party services.
The Service may contain links to external websites or resources. GweensCraft does not endorse and is not responsible for the content or practices of any linked third-party sites.
13. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Agricultural advice
Recommendations generated by the AI disease-detection model, sensor alert thresholds, and agronomist consultation responses are provided as informational guidance only. Gweens AgriTech does not guarantee specific crop yields, revenue outcomes, or the effectiveness of any recommended treatment. Farming involves inherent risks including weather, pests, and market conditions that are beyond our control.
Sensor accuracy
As described in Section 8, sensor readings are indicative. We do not warrant that sensor data is accurate, complete, or fit for any particular farming decision.
Service availability
We aim for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or factors outside our control. We are not liable for losses arising from Service unavailability.
Weather data
Weather forecasts are sourced from OpenWeatherMap and are provided for informational purposes. We are not liable for decisions made based on weather data that proves inaccurate.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY KENYAN LAW, GWEENSCRAFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF CROPS, LOSS OF PRODUCE VALUE, LOSS OF REVENUE, LOSS OF DATA, OR LOSS OF BUSINESS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
GweensCraft's total aggregate liability to you for any claim arising from or related to the Service shall not exceed the total fees paid by you to GweensCraft in the 12 months preceding the claim. Where you have used the Service on a free plan, our aggregate liability is limited to KSh 10,000.
Nothing in these Terms excludes or limits liability for death or personal injury caused by GweensCraft's negligence, or for fraud or fraudulent misrepresentation.
16. Indemnification
You agree to indemnify, defend, and hold harmless GweensCraft, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your violation of these Terms
- Your use of the Service in violation of applicable law
- Your User-Generated Content, including false marketplace listings or misleading reviews
- Any dispute between you and another user (e.g., a farmer-buyer transaction dispute)
17. Termination
By you
You may close your account at any time via Settings → Data Management → Delete My Account. Upon account deletion, your access to the Service terminates immediately. Data deletion follows the schedule described in the Privacy Policy.
By GweensCraft
GweensCraft may suspend or terminate your account with immediate effect if:
- You breach these Terms in a material way, including fraudulent marketplace listings, impersonation, or prohibited use
- You engage in behaviour that endangers other users, the platform, or third parties
- We are required to do so by law or court order
For lesser violations, we will ordinarily provide a warning and opportunity to rectify before suspension. We will notify you of any termination by email unless doing so is prohibited by law.
Effect of termination
Upon termination, all rights granted to you under these Terms cease immediately. Any pending marketplace orders will be completed or cancelled according to the order status at the time of termination. Sections 10, 14, 15, 16, and 18 of these Terms survive termination.
18. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.
Any dispute arising from or in connection with these Terms that cannot be resolved through good-faith negotiation shall be submitted to the exclusive jurisdiction of the courts of Nairobi, Kenya.
Nothing in this clause prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction where necessary to protect intellectual property or prevent imminent harm.
19. Changes to Terms
GweensCraft may revise these Terms at any time. When we make material changes, we will:
- Update the "Last updated" date on this page
- Send you an in-app notification or email at least 14 days before the revised terms take effect
Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree with the revised Terms, you must stop using the Service and delete your account before the effective date.
